Terms of Service

These terms govern your school's use of the Phoenix Wellbeing Tracker ("the Service"), provided by Phoenix Education Consultancy, trading as PECTECH ("we", "us"). By using the Service you agree to these terms.

The Service

The Service is a wellbeing assessment, intervention and reporting tool for schools, covering the eight Phoenix domains. We may improve or change features over time; we will not materially reduce core functionality during a paid subscription term without notice.

Accounts and access

  • Your school is responsible for the accounts it creates and for keeping login credentials secure.
  • Access is role-based; users must only access pupil data their role and relationships permit.
  • You must notify us promptly of any unauthorised use of an account.

Acceptable use

You agree not to:

  • use the Service unlawfully or in breach of your data-protection obligations;
  • attempt to access data belonging to other schools or to circumvent access controls;
  • upload malicious code or attempt to disrupt the Service.

Data protection

The school is the data controller and PECTECH is the data processor for pupil and staff data entered into the Service. Our handling of that data is governed by our Privacy Policy and the data processing agreement between us. UK data-protection law applies.

Availability

We aim to provide a reliable Service but do not guarantee uninterrupted availability. We may carry out maintenance and will give reasonable notice of planned downtime where practical.

Intellectual property

The Service — including the Phoenix framework, software and design — remains the intellectual property of PECTECH and Phoenix Education Consultancy. Your data remains yours.

Fees

Subscriptions are billed as agreed with your school or trust. Prices exclude VAT, which is charged at the prevailing UK rate.

Liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, the Service is provided "as is", and our liability is limited as set out in your subscription agreement.

Termination

Either party may end the subscription in line with the subscription agreement. On termination, data is handled as described in the Privacy Policy and data processing agreement.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
